Las actas de Crawford y sus consecuencias penales

RESPUESTA:La querella criminal presentada por Izquierda Unida, acompañada por 11.000 firmas, fue inadmitida en el proceso de trámite del Tribunal Supremo. Está recurrida en amparo ante el Tribunal Constitucional.

Esta pregunta y muchas otras relacionadas, enviadas por un gran número de lectores, merecen una respuesta un poco más amplia.

El pasado 20 de marzo, con ocasión del cuarto aniversario de la invasión de Irak, el juez Baltasar Garzón, titular del juzgado central de instrucción Nº 5 de la Audiencia Nacional, escribió un artículo en las páginas de opinión de EL PAIS. Antes de considerar lo que él opina ahora es interesante dejar constancia que en los primeros días de marzo de 2003, exactamente el día 4 de marzo, el juez Garzón escribió una carta titulada "Sr. Presidente" en las páginas de opinión de éste periódico. En ella al hilo de la reunión de Crawford entre Bush y Aznar, intentaba disuadir a Aznar de su apoyo a Bush y a la guerra inminente."Ustedes deben decidir en qué bando juegan, si en el de la legalidad internacional y nacional, pero la real, no la del marketing, ni la fatua, ni la de las palabras huecas, o en el bando de la falsedad y del interés oculto que pretenden sobornar nuestras consciencias ofreciéndonos las riquezas de las minas del Rey salomón", apuntaba el juez.

Y, además, advertía sobre el riesgo del terrorismo internacional. "Lo único que va a generar esta injusta guerra [quince días antes del inicio del ataque y la inmediata invasión] es, por una parte, una quiebra ya inevitable de la legalidad internacional, y por otra, el aumento del terrorismo integrista a medio plazo, el cual hallará una plataforma de justificación objetiva, de la que ahora carece", escribió Garzón. Y se preguntaba: "¿Cómo se puede apoyar a un líder o a un país que está violando groseramente los mismos derechos que dice defender [en referencia a los presuntos terroristas detenidos en Guantánamo]?

Bien, dicho esto, veamos que dice ahora el juez Garzón. "Creo que ha llegado el momento de hacer una reflexión seria y detenida sobre lo sucedido y lo que está ocurriendo en Irak, en una doble dirección. Por una parte, debería profundizarse sobre la eventual responsabilidad penal de quienes son o fueron responsables de esta guerra y si existen indicios bastantes para exigirles dicha responsabilidad. Para muchas se tratará de una mera responsabilidad política, pero comienzan a aflorar acciones judiciales en Estados Unidos, como se ha demostrado con la condena de uno de los colaboradores del vicepresidente [Richard] Cheney, que apuntan en la otra dirección. Seiscientos cincuenta mil muertos son un argumento suficiente para que esa investigación o indagación se aborde sin más dilación".

Muchos lectores han preguntado si el acta de la conversación de Crawford podría ser un indicio sobre la responsabilidad penal de los que han impulsado la guerra. Ésta es una buena pregunta para el juez Garzón, uno de los jueces que ha aplicado y creado jurisprudencia en el derecho internacional con la instrucción de los casos de los desaparecidos y asesinatos durabnte las dictadura de Argentina y Chile, y con el arresto del general Pinochet en Londres.

Pero hay un elemento a tener en cuenta: Bush confía a Aznar el 22 de febrero de 2003 que a finales de marzo de 2003 el Ejército de EEUU entraría en Bagdad. Aznar es consciente en la entrevista de que es necesaria una segunda resolución del Consejo de Seguridad de Naciones Unidas. Entre otras cosas hay que recordar dos informes de la asesoría jurídica internacional del ministerio de Asuntos Exteriores español de octubre de 2002 y primeros días de marzo de 2003, respectivamente, en los que se apunta que no hay mecanismo automático de activación de la intervención militar en las resoluciones de Naciones Unidas sobre Irak (Resoluciones 1284 y 1441) y que por tanto el Consejo de Seguridad debe considerar la situación creada, evaluar los progresos o falta de ellos, realizados por Irak en el cumplimiento de las obligaciones de desarme impuestas por el propio Consejo y de las mayores probabilidades de culminar los objetivos perseguidos mediante la continuidad de la labor emprendida por los inspectores de la Unmovic (comisión de verificación) y del Organismo Internacional de Energía Atómica (OIEA).

Y, pese a todo ello, Aznar apoya incondicionalmente a Bush y su guerra en Irak, enviando 1.100 soldados españoles.

Indicios penales, por tanto, como las meigas, haberlos, haylos.

ANSWER: There is a criminal claim presented by Izquierda Unida with 11.000 signatures that was not admitted in the Supreme Court of Spain. There is an appeal pending in the Constitutional Court.

This question by Jaime Rosello Muedra and a lot of others related, require a more open picture.

Last 20th of March, 2007, on the fourth anniversary of the invasion of Irak, Judge Baltasar Garzón, in charge of juzgado central de Instrucción Nº 5 of Audiencia Nacional, wrote in EL PAIS an op-ed article. Before considering what he thinks now, it is interesting to recall that in the first days of March, 2003, the 4th of March, Judge Garzón wrote a letter titled "Mr. President" in this same paper. It was in relation with Aznar visit to Crawford. Judge Garzón make a very dramatic call to avoid the inminente war.

"You must decide in what side you play, in the side of international and national legality, but the real one, no that of marketing, the foolish one, that of empty words, or in the side of lies and the hidden interests that have the goal of buying our consciousness offering the wealth of the mines of King Solomon", wrote Judge Garzón. And he anticipate the risks: "The only consequences of this unjust war is, on one hand, the inevitable breach of international legality, and on the other hand, the increase of radical islamic terrorism in the medium term, giving to the terrorists a platform of objective justification, that has not right now".

Well, having said that, what is now thinking Judge Garzón? "I believe that we arrive at the point of making a serious and calm reflection about what happened. One one side, we must go in deep about the possible criminal responsabilities of the people responsible of launching this war and if there are sufficient evidence to take them to claim there responsability. In some cases, it will be simplye political responsability, but at the same time we do know that it is the beginning of judiciary actions in the US, as it has been seen with the conviction of one of the aides of vicepresidente [Richard] Cheney, that point to the other direction. Six hundred fifty thousand killed are enough as an argument in favor of making that investigation without further delay".

A lot of readers asked if the transcript of Crawford could be an evidence about the criminal responsability of those that rush to the war. This is a good question for Judge Garzón, the magistrate that created jurisprudence in international law with the cases of dissapeared and killed under the dictatorships of Argentina and Chile. And last but not least, with the arrest of General Pinochet in London, October 1998.

But let me say that there is an element to take in account. Bush inform Aznar 22 of February 2003 that the US Army is entering in Bagdad final days of march 2003. Aznar is well aware that it is necessary a second resolution at the Security council of UN.

And this is not a minor point of detail. Why? Because the Aznar Government ha'd, at least, two reports of the International Counsel Office of the Ministry of Foreign Affairs (october 2002 and first days of March 2003, before the war) that said there there were not any "automatic mecanism of activation" of war in the Security Council Resolutions (1284 and 1441) and that the Security Council need to consider the situation created, make an evaluation of the progress of lack of them, undertaken by Irak in the compliance of his obligations of disarming that were imposed and the possibilities of reaching the goals established trough the continuity of the work of the inspectores of Unmovic (UN verification commission) and the International Atomic Energy Agency (IAEA).

And despite of all this Aznar supported inconditionally Mister Bush and the war of Irak. Criminal evidence of a breach of international law, thus, like the Meigas (the witches of Galicia), does exist, they are within reach.
